There has been a marked increase in damage claims for the abstraction of spring and ground water for the purposes of public water supply over the last few years. In many cases, the substantial differences of opinion that exist between water supply undertakings and landowners have made it impossible to reach agreements. So far there is not special jurisdiction providing, apart from the exact allocation of property, a basis for monetary assessment. The uncertainty involved tends to result in a lack of uniformity among the sworn experts as to the assessment methods used and gives rise to estimates that are difficult to comprehend. This issue of Osterreichische Wasserwirtschaft presents the newly developed assessment model for spring water. It will be possible in the future to specify comprehensible water assessments and levels of claims for landowners and water supply undertakings. Qualitative and quantative differences among water sources can be allowed for. [Geobase]
